Directions: |
|
|
Go south out of Fillmore on Co Rd 550E about ½ mile to the T.
Turn left on Co Rd 50S and go east about one mile to the T. Turn right on Co
Rd 625E and go south about ¼ mile. The road will turn left and become 100S.
Go east about ¼ mile. There will be a small white house on the north side,
and just a bit further a new brick house with a metal pole barn off the road
a little, also on the north side. Between these two houses is a field. In the
field there is a small hill or knob. The stones are on this knob laying flat
on the ground. |

Cemetery
is on a knoll in the middle of a field. The farmer appears to be going around
the cemetery, but is farming dangerously close to the stones. The stones are
laying flat and need to be reset. It would be nice to erect a sign and some
barriers to ensure the farmer won’t hit the stones. Property owner and farmer
should be informed this is a violation of IC 14-21-1-26.5 which prohibits
disturbing the ground within 100 feet of a cemetery without filing a
development plan with DNR. IC
14-21-1-24 specifically includes disturbing the ground for agricultural
purposes within IC 14-21-1-26.5. Thus, someone who farms within 100 feet of a
cemetery commits a Class C misdemeanor. If a person disturbs human remains or
grave markers while committing this offense (i.e. nicks the tombstones with a
plow) he has committed a Class D felony. This statute should not be taken
lightly. |
